This course will examine some of the jurisprudential, legal and ethical issues presented by past wars and the current war against terrorism. This will include examination of related case law, legislative, and public policy developments.We will study the relevant Supreme Court opinions that circumscribe the Court's recognition and restriction of civil liberties in time of war. In particular we will seek to articulate the balance between the Presidential war powers and civil liberties. The Supreme Court in 8 seminal cases spanning the time period from the civil war (Milligan) through the war on terrorism (Boumediene) deals with the wartime power of each branch of government. It is assumed the student is familiar with the balance of powers concepts from the Constitutional Powers course. This course will look closer at the application of those powers affecting habeas corpus and other civil liberties. Grading: Letter graded. Credits: 2 Offered: Spring
